Applying to the Court of Protection is essential when an individual no longer has the mental capacity to make decisions for themselves, particularly in situations involving disputes, complex care needs, or the need for protection against abuse.

You can apply for a Court of Protection to ensure their best interests are protected.

The court's involvement ensures that the rights and interests of vulnerable individuals are safeguarded, providing a legal framework for making important decisions on their behalf.

Reasons for applying:

  • Lack of mental capacity - If someone can no longer manage their own affairs and doesn’t have a Lasting Power of Attorney in place, you may need to apply to the Court of Protection to appoint a deputy to act for them.
  • Family disagreements - If there is disagreement between family members, or between family and professionals, about what is in the person’s best interests, the court can make a final decision.
  • Complex decisions - The court is often involved in more complex matters such as medical treatment, living arrangements, or finances, especially where there is no agreement among those involved.
  • Protection from abuse - The Court of Protection helps protect vulnerable people from financial abuse by overseeing deputies and ensuring their affairs are properly managed.
  • Urgent situations - In emergencies where decisions need to be made quickly, the court can step in to provide a timely resolution to protect the individual’s welfare.

  3. Your personalised plan – Following your initial appointment, we’ll send you a plan designed around your needs. This will be tailored completely to your set of circumstances and may include some or all of our service options.
  4. Review meeting - In this appointment, we will discuss our recommendations with you, answer any questions and ensure you fully understand your options. This will either be face-to-face, or online via zoom or teams (depending on your location).
  5. Considering your options - Following the review meeting, you'll have time to review everything, giving you time to check everything over and ensure you’re happy with the service we have proposed to you.
  6. Happy to proceed with the service(s) - Once you’re happy to proceed, your plan will be put into place, and any documents will become valid once signed and witnessed.

Depending on the services you’ve instructed us for, there may be a longer process and additional work. For example, Probate and Court of Protection take much more work and time.
